wondering legality of my avatar...

while it is a thumbnail of copyrighted (presumably) photo of a trademarked character, it is just an avatar...or is it? so...I was wonder what the general frown-upon-factor might be for having an avatar such as the one I have, not to mention on a board such as this. anybody have any thoughts?
or what might be the frown-upon-factor of making a drawing of this tiny scene and using that instead?

I vote the latter. You're thinking too much about it. I daresay your copyright infringement is waaaay too small for either DC comics or Adam West to get litigious about.
